Vehicle Rollaway Accidents Subject To Personal Injury Lawsuits A Vehicle Rollaway Accident is defined as any instance when a car or truck moves without a driver. The most common cause of these accidents is when the vehicle's transmission shifter is not properly placed in the PARK position or it "slips" out of the PARK position. Small children playing in a vehicle is another common cause of a rollaway accident. Safety critics have complained for years that automobile manufacturers have failed to incorporate the most recent technology in hardware and software to make vehicles safer. Failure to add proven safety systems - which have a very low cost - is an issue that personal injury lawyers can use in a personal injury lawsuit. Overall the automotive industry has a poor to mixed record on safety issues. Rather than leading the world in automotive safety the industry is usually forced to adopt safety equipment and systems by federal law or federal mandate. Currently automotive safety critics are arguing the the industry should adopt both 1) Electronic Parking Brakes, and 2) Electronic Shifters that automatically engage when the driver's door is opened and the vehicle transmission shifter is NOT in the PARK position. More than likely more multi-million dollar personal injury lawsuits will persuade the industry to adopt these relatively inexpensive safety systems. Or maybe the federal government will force them to do it.
