Texas Limits Non-Economic Medical Malpractice Awards In a frenzy of bad law-making in 2003 Texas politicians decided to limit medical malpractice awards in the state. Non-economic awards are limited to $250,000. After legal expenses and lawyer fees the amount could easily be half or less that amount. This law does NOT benefit the citizens of Texas. It benefits large health care corporations, hospitals, and doctors who harm or kill their patients. Medical errors in the United States are now the 3rd leading cause of death of Americans, behind heart disease and cancer. It is a cruel law that affects newborns and children the most because they have no economic income to claim economic damages. What do you tell the parents of a child that has lost all 4 limbs due to medical errors that she will probably recieve less than $100,000 as compensation for her loss? Texas is one of the states that has NO mandatory reporting of "NEVER EVENTS", medical errors that are identifiable, serious, preventable, and should NEVER happen. This includes wrong hip implants, wrong knee implants, wrong site surgery, wrong blood transfused, injection into the wrong eye, foreign objects left inside patients' bodies, and more.
