The Covid 19 Pandemic has drastically changed the way workers compensation cases are handed. Beginning the middle of March 2020 all trials at the WCAB were postponed pending further notice. Now we are starting to have trials, but they are video only. To date no one has formally challenged the right of the WCAB to adjudicate by video and some judges will not. However, increasingly options are being made to accommodate and develop video trials using Lifesize, which is a video Internet provide like Zoom only with better encryption. Similarly I am increasingly being asked to have my clients sit for video depositions. There is a learning curve for video, so practice is important.
