Although he refused the breath test, a later blood test returned a result of .14% BAC. After much negotiation with the district attorney, we successfully settled this case today for a dismissal of the DUI charges in lieu of a plea to the reduced charge of "reckless driving." As a result, his sentence was significantly reduced. Client sentenced to ONE year of informal probation, a fine of approximately $1,200, a 3 Month DUI School and 96 hours of community service. Client opted for a "restricted license" whereby after installation of an ignition interlock device ("IID"), he was able to get a license without any actual suspension.
