Dear readers/visitors, This post is about Mutual Divorce & Contested Divorce. This order (in picture) is also with reference to a review posted by our client Ms. Lakshita Kaushik. We will discuss here that how statutory cooling off period of 6 months in Mutual Divorce is reduced. Generally family Court does not entertain any application reducing cooling off period submitted by lawyers in U.P. Courts because no amendment has been done in the Hindu marriage Act. There are just some cases of Hon'ble Supreme Court. Waiver of cooling off period is a discretionary power of the Court, and we have experienced that it is almost impossible to convince the family Court judge(s). Our clients who want Courts to hear their case ASAP, we advise them to adopt this measure. If any person or lawyer claims that he can reduce the statutory cooling off period from 6 months to 1 month or so, by just filing an application of waiver before the family Court, or he will request orally without any effort, then this situation can be very confusing and damaging in future for clients and client attorney relationship. We move an application under article 227 before the concerned High Court. High Court waves the cooling off period from 6 month to 2-4 weeks.
