Legislative Update

That Affects Your Responsibilities As An Employer

According to National Law Review, Colorado has enacted four new laws that create sweeping changes to the state’s employment landscape in 2024.

  1. The Protecting Opportunities & Worker’s Rights Act (POWR) https://leg.colorado.gov/bills/sb23-172 – Among other things, this law voids non-disclosure agreements unless they meet several conditions; requires employers to provide training and education programs for workplace civility, harassment and more
  2. The Job Application Fairness Act (JAFA)https://leg.colorado.gov.bills/sb23-058 The act prohibits employers from inquiring about a prospective employee’s age, date of birth, and dates of attendance at or of graduation from an educational institution on an initial employment application. 
  3. Amendments to the Colorado Healthy Families and Workplace Act (HFWAJ)https://cdle.colorado.gov  This requires Colorado employers to provide two types of paid sick leave to their employees: accrued leave and public health emergency leave (PHE) with is not currently in effect.  
  4. Amendments to the Colorado Equal Pay for Equal Work Act –https;//cdle.colorado.gov  The amendment gives more investigatory powers to the CDLE and modifies job posting disclosure requirements for employers.

Effective January 1, 2024, the minimum wage in Colorado is $14.42 per hour.
