Hayes solicitors represented the University of Limerick and Plassey Trust Company Limited in their successful judicial review proceedings against Irish Water (Uisce Éireann) in relation to the decision to reclassify the supply of water to student accommodation as “non-domestic”. As a tool, advocates and judges have noted that active judging has been particularly effective in landlord-tenant court because tenants often face power imbalances and asymmetries in information related to eviction courtroom proceedings. In a recent event, from the National Center for State Courts, judges from three different jurisdictions discussed how they have adopted principles of active judging to increase understanding, ensure due process, and expand access to resources for litigants in eviction court. The panelist judges outlined several techniques that can be used to address the myriad of obstacles litigants may encounter in the eviction court process.

Paul Wilmshurst successful in High Court commons case
In 𝘙𝘶𝘴𝘩𝘮𝘦𝘳 𝘷 𝘊𝘦𝘯𝘵𝘳𝘢𝘭 𝘉𝘦𝘥𝘧𝘰𝘳𝘥𝘴𝘩𝘪𝘳𝘦 𝘊𝘰𝘶𝘯𝘤𝘪𝘭 [2023] EWHC 1341 (Ch), the court grappled with complex issues surrounding registered common land affecting two private properties.
🔍 The case involved doubts about the extent of the commons register and the validity of the maps used for registration. Surprisingly, several alternative maps were discovered, adding to the Claimants' concerns. However, the court dismissed the Defendant's jurisdiction claim and reaffirmed the principle of declaring public rights' impact on private property without resorting to judicial review.
💡 Most notably, the court clarified the applicability of the Scheme for the Regulation and Management of Studham Common 1911, and how it interacts with the commons registration system.
This judgment by Mr. Nicholas Thompsell, acting as a deputy judge of the High Court, will be a crucial reference point for future disputes regarding common land boundaries. ⚖️
