Divorce and Legal Separation

Whether you seek to end your marriage by divorce or legal separation, let our attorneys lay out your options and assist you in selecting the path that best suits your circumstances and desired outcome.

Child Custody / Placement

The welfare of children is always a prime concern in a divorce. A court will ultimately make orders about decision-making processes and periods of physical placement with each parent. It is our job to make sure that your children’s health and happiness are assured. We will help you devise a plan, for the court’s approval, that will spell out the appropriate custody / placement rights, always with your children’s welfare as the top priority.

Child Support

When you divorce it is our job to assist you in obtaining a court order mandating the method of providing financial and medical support for your children. It is also extremely important that these provisions are adhered to by all parties and monitored over time. We will assist you by working with the court to put in place the necessary safeguards to assure compliance.

Maintenance (Spousal Maintenance or Spousal Support)

If you choose to divorce, one spouse may be required to pay maintenance to the other either during the divorce process and/or after. Who receives maintenance depends on numerous factors under Wisconsin law. It is our job to make certain you understand how a judge determines this important issue.

Restraining Orders

Domestic Abuse/harassment can occur in a marriage or with a boyfriend/girlfriend. We are here to assist you in obtaining a restraining order or if appropriate, defending you against false accusations.

Paternity

If you wish to start a paternity suit, we will assist the mother/father in initiating a legal proceeding to determine the father of a child. Our representation will include working with you regarding custody/placement and child support.

Pre-nuptial Marital Agreements

A prenuptial agreement or premarital agreement (commonly referred to as a prenup), is a written contract that you may wish to enter into with your soon-to-be spouse prior to marriage. We will construct an agreement that provides you with options to select and control many of the legal rights you acquire upon marrying, and what happens should the marriage end by death or divorce. This will allow you to enter into a written agreement which supersedes many of the laws that would otherwise apply in the event of divorce/death.

Post-nuptial Marital Agreements

Like the contents of a prenuptial agreement, provisions vary widely but commonly include provisions for division of property, debts and spousal support in the event of divorce, death of one of the spouses, or breakup of the marriage. The difference is that we will assist you in entering into that agreement once you are already married.

Post Judgment Matters

Many times, even after your divorce or family law matter is complete, issues will arise that require additional legal advice. Collectively called “post-judgment matters”, these issues can involve enforcement of agreements or orders of the court, or might require modifications of child support, maintenance, custody, or placement.
