Not good Attorneys to me. I had EEOC case they agreed to litigation after I won my Right to Sue when My case is proven. I did win the right to sue fromm EEOC, Phillips and Associates said congratulations! Then told me they no longer want to represent me. I was poor person. Told me go Pro se. I found out the company filed for bankruptcy in parallel with my winning the right to sue from EEOC. Phillips and Associates said yeah we got notice, that happens we don't know what to do now go find another lawyer or go Pro Se in District Court we can't afford a poor person, your a poor person and can't afford us now the company filed bankruptcy. Go to someone else.
I was demanded to bill this company by the bankruptcy court, they demanded response from my lawyer, once learnt Phillips and Associates dissed me they laughed and mocked me for not being a lawyer and my representatives and they case went dead.
No other Attorneys wanted to represent me due too I was retained by Phillips and Associates originally.Helpful 3Thanks 0Love this 0Oh no 0Business owner information

HI Yajaira,
I’m sorry to hear about your disappointment. I am very aware of your situation. I do think you have misunderstood what a Notice of Right to Sue issued by the EEOC means. Generally, when a person receives a Notice of Right to Sue (“RTS”) it means the EEOC decided NOT to bring a lawsuit and handed the case back to you or your lawyers to decide the proper course. This is different than where the EEOC investigates and files a lawsuit to enforce the law AFTER finding that there was reasonable cause to believe discrimination has occurred.
If the EEOC chose not to file a lawsuit and issued a RTS, it typically indicates that the EEOC’s investigation did not unearth anything that, in the investigator’s opinion, constituted unlawful discrimination. This notice is a prerequisite and gives you permission to file a lawsuit in federal or state court. See below.
https://www.eeoc.gov/filing-lawsuit#:~:text=Charge%20Filing%20and%20Notice%20of%20Right%2Dto%2DSue%20Requirements&text=You%20may%20also%20request%20a,in%20federal%20or%20state%20court.
Additionally, filing a lawsuit against a company in bankruptcy is outside the scope of our practice area. We are not bankruptcy attorneys and suing a company in bankruptcy is very different than filing a discrimination case in civil court. Besides the financial cost and chances of recovering money being more difficult, these cases need to be filed in bankruptcy court. We are not familiar with bankruptcy laws and proceedings. That is why we referred you to a bankruptcy attorney. Please feel free to call me at 212-248-7431 if you would like to discuss this further. Again, I’m so sorry for your frustration and understand the difficulty having to deal with a bankrupt company. All the best, Bill Phillips - Syed N.NY, NY01Jun 16, 2023
Jitesh Dudani is a very professional, efficient, thoughtful, sensitive, and supportive lawyer. At the time I came to the firm, I was unlawfully terminated after being harassed. I felt that there was no hope and could not find anyone to support me, to believe in me. However, Mr. Dudani comforted and guided me throughout the journey and made sure that every aspect of my case was reflected, representing me diligently. Phillips & Associates worked with me during a really hard time dealing with the issues and getting me justice. I would definitely recommend this law firm.

Jitesh Dudani was nothing short of exceptional. When he was brought on to my case I was hesitant because the matter was very sensitive and uncomfortable. I was not sure I would be able to openly discuss details of my case with him. I soon found this to be untrue. Jitesh Dudani has a very trusting and calming nature and was very intune with my emotions. He was able to both show sensitivity while being honest, upfront and direct. What really impressed me and truly made me put my trust in him was reading the information he gathered by just listening to me. He made me feel heard and understood. Jitesh fought for me and my rights when it was time to be aggressive and comforting when the weight and emotions of my case were becoming difficult to handle. I would recommend him to anyone in a similar situation. I appreciate all he did for me with my case and appreciate the knowledge that others going through these difficult and sensitive cases will be defended by Jitesh.

Attorney Gregory Kirschenbaum from Phillips and associates represented me and never once did I doubt I was in the best possible hands. Phone calls were returned without delay. I'd recommend him to anyone in need of legal representation.

I had to keep pushing my lawyer Silvia for what I believe I actually deserved and now after a year of settling I regret it terribly. She wanted me to settle for 10,000 and I kept saying no. They ended up paying 50 but she got 20 which I didn't think she deserved because it was my push that got our settlement that much. Should have went somewhere else. I wouldn't recommend

This law firm was very helpful in my case. I finished off my case with Shawn Clark. He was remarkable. He kept me updated on my case every step of the way. Any questions I had he answered and in terms I could understand. I was always given options but I trusted his process. If you had any issues with attorneys the partners will find you an attorney you feel comfortable with. Shawn Clark was very honest and very professional. Melissa Vo was another attorney that truly helped me as well. She made me so comfortable and calmed my nerves. I felt like they were family fighting my case for me. My outcome was great but the case was very nerve wrecking and anxiety filled. These attorneys made the process smooth. I'm very satisfied with Shawn Clark and Melissa Vo.

I had such a wonderful experience working with Phillips & Associates, especially Cathryn Harris-Marchesi. She was a pleasure to work with. Cathryn really took the time to listen to me not only as a client, but as a person and she had my best interest at heart at all times. Not only was she professional, she was genuine and I felt that in all of our interactions whether it was over the phone or email. Her staff was very helpful and professional as well. I would highly recommend Phillips & Associates.

As a CEO who deals with attorneys on a daily basis, I feel qualified to make the following recommendation. STAY AWAY from Phillips & Associates. My attorney Steven Fingerhut all but laid down for opposing council. I had a VERY strong case against an employer with a billion dollar endowment. My work was exemplary and highly reviewed. My employer not only abused time and hour wages against myself and others, but was discriminatory in handling my employment and concealed their termination of my contract without cause, due to my race, sex and politics. These were documented and instead of digging into the case, Mr. Fingerhut folded like a sheet the minute opposing legal council responded. To date, I have never seen a hired attorney fail to push back and actually beg their client to "move on" and "put this behind you." This was solely based on time and expense calculations of the firm and failure to get into a messy legal battle with one of New York's largest employers.
To add insult to injury, Mr. Fingerhut was not even able to secure a tiny settlement that was paid as a 1099 (which is customary) and instead allowed the opposing party to once again pay the pittance of a settlement that was offered as a bonus of wages. Completely uncustomary for the industry and increased the already poor payout that was offered as a "nuisance payment." Again Mr. Fingerhut recommended that I "move on" and failed to fight for the wrong that was obviously being done. Of course his firm collected their share.
In short, this firm is unable to fight for their claimants, use any creative means or investigatory leverage to secure and help their clients, in my experience. This left me feeling completely abused and harmed not only by a despotic employer, but by an impotent firm that took my case with fervor, than sputtered to a dismal halt. If you have a serious case regarding discrimination, look elsewhere and find a firm that will back you up, investigate the matter deeply, and take it to the finish line. Learn from my mistake.Helpful 1Thanks 0Love this 1Oh no 0Business owner information

Hi Matty,
I'm sorry to hear you are unhappy. I can assure you we always fight to get our clients the most beneficial resolution we can achieve without putting them at risk. As I'm sure you are aware- if a case or claim cannot be proven in court it can be dismissed and our client may be liable for costs and fees which could be thousands of dollars. Additionally, if an employer can show a person was fired for a nondiscriminatory reason the case can also be dismissed. For this reason, we are constantly conducting a risks/benefits analysis as a case proceeds, both before filing a lawsuit and during the litigation process.
Clients are always free to get a second opinion or can take their case to another attorney. We never force our clients to settle their cases or to file their cases in court. We provide guidance and insight to help them with that decision, and I believe Mr. Fingerhut suggested a few options to you.
Also, a majority of our cases are filed in court and, to date, we have filed thousands of cases. We also take cases to trial and Mr. Fingerhut was even on trial a couple of weeks ago. While we do offer guidance based on our years of experience in employment cases, ultimately, it's the client's decision to resolve his or her case or to move forward to court.
Please feel free to reach out to me personally if you would like to discuss this further in private.
All the best,
Bill Phillips

With such a difficult decision and circumstances, I feel very fortunate to have found Silvia Stanciu with Phillips & Associates. She was very professional, patient, educated, driven and client focused. She was compassionate, but realistic, factual and aggressive when it came down to the details. I feel as though she actually had my best interest in mind and listened to me throughout the whole process. She was always professional and made time to talk regardless of the time and kept me updated every step of the way. I would never wish my circumstances on anyone, but if I had to do it again or if someone was in a similar circumstances, I would highly recommend Silvia at Phillips & Associates.
