I understand you are unhappy we had to release your case, as that is not the outcome either of us desired. Unfortunately, as you mentioned, the defendant in your case had no insurance, and you had no first-party insurance.

Over the past few months, our firm sent defendant threat letters, deployed an investigator to try to locate insurance coverage from the defendant, ran policy searches to see if there was another form of insurance we could pursue, and ran background checks on the defendant to search for assets. Through those efforts, we assessed that there was no viable way for us to obtain a recovery for you.

Although you can file a car accident lawsuit when you are hit by an uninsured driver, injury attorneys and insurance companies rarely do so because the uninsured driver is considered “judgment proof”. What this means is that even if you obtain a judgement against the uninsured driver, they do not have sufficient assets to respond to collection efforts.

Further, being “judgment proof” means that your property and income cannot be seized by creditors, because it is “exempt” by law from the creditor’s claims. If your income and property is exempt, then you have nothing the creditors can take from you. Unfortunately, we determined that appears to be the case with the uninsured driver that crashed into you.

I know that outcome is highly frustrating and am sorry that Texas law does not provide more remedies for innocent accident victims such as you. Unfortunately, an estimated 1 in 6 drivers in the DFW-area are uninsured, so situations such as yours are all too common. However, as with all such cases our firm handles, we charged you nothing for the considerable investment of our firm's time and resources expended in coming to that unfortunate conclusion.
